Driving Under The Influence (D.U.I.)
Georgia's
laws concerning D.U.I. are among the toughest and most complex in the
nation. Many changes to our D.U.I. laws took effect on July 1, 2001.
One important change was a reduction in the "per se" D.U.I.
blood alcohol level from .10 to .08.
If you have been arrested and charged
with driving under the influence of alcohol or drugs, or a combination

may only have ten (10) business days from the date of your arrest to save

What is the maximum sentence for
a D.U.I conviction or guilty plea?
The answer depends on many factors,
including the defendant's age at the time of arrest, the number of D.U.I.
convictions or guilty pleas within the previous five years (measured
from the date of arrest to the date of arrest), and other factors.
For a first D.U.I. in five years:
*21 years of age or older:
$300.00 to $1000.00 fine plus applicable
surcharges
Minimum 40 hours community service (no stated maximum)
Completion of D.U.I. Risk Reduction School
Minimum 24 hours in jail
*Under 21 years of age:
$300.00 to $1000.00 fine plus applicable
surcharges
Minimum 40 hours community service (no stated maximum)
Completion of D.U.I. Risk Reduction School
Minimum 24 hours in jail
Mandatory loss of driver's license for 6 or 12 months, depending on
the B.A.C. (blood alcohol concentration)
For a second or third D.U.I. within
five years, the maximum potential sentences increase drastically.

Will I lose my driver's license?
Again, the answer depends on many factors.
Drivers under 21 who are convicted of or plead guilty to a first D.U.I.
within five years face a minimum 6-month loss and maximum 12-month loss
of their driver's license or privilege to drive on the roads of Georgia.
Drivers 21 or over who are convicted of or plead guilty to a first D.U.I.
within five years face a 12-month loss of their driver's license or
privilege to drive on the roads of Georgia. Drivers faced with
a second or subsequent D.U.I. within five years face much longer potential
suspension times.
